These Terms of Service ("Terms") govern your use of the BrigadeOps platform ("Platform"), operated by The Brunch Brigade N.V. ("Company," "we," or "us"), accessible at brigadeops.com. By accessing or using the Platform, you agree to be bound by these Terms.
1. Platform Usage
BrigadeOps is a business-to-business operational platform that provides catering management, food ordering, kitchen production tracking, dispatch logistics, and corporate meal management services. The Platform is intended exclusively for authorized business users provisioned by their respective organizations. Unauthorized access, reverse engineering, data scraping, or any use beyond the scope of your assigned role is strictly prohibited.
2. Account Responsibilities
User accounts are created and managed by client organization administrators. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You must notify your organization's administrator immediately upon discovering any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or pose security risks to the Platform.
3. Ordering Responsibilities
Users placing orders through the Platform are responsible for ensuring accuracy of order details, including menu selections, quantities, dietary requirements, and special instructions. Orders must be submitted within the designated cutoff times established by your organization. Late submissions may not be accommodated. Group order supervisors bear additional responsibility for verifying consolidated orders before submission.
4. Delivery Limitations
Delivery services are provided to designated locations as configured by client organizations. Delivery schedules, routes, and coverage areas are determined by operational capacity and logistical constraints. While we endeavor to deliver all orders within scheduled timeframes, delays may occur due to circumstances beyond our reasonable control, including but not limited to traffic conditions, weather events, access restrictions, or force majeure events.
5. Address Accuracy
Users and client administrators are responsible for providing accurate and complete delivery addresses, including building names, floor numbers, office designations, and any access instructions required for successful delivery. We are not liable for failed or delayed deliveries resulting from inaccurate, incomplete, or outdated address information.
6. Payment Terms
Payment for services rendered through the Platform is governed by the commercial agreement between The Brunch Brigade N.V. and the respective client organization. Individual Platform users are not directly invoiced unless explicitly arranged. Payment disputes should be directed to your organization's procurement or finance department, who may liaise with us as necessary.
7. Modification and Cancellation
Orders may be modified or cancelled prior to the applicable cutoff time. Once an order has been locked for production, modifications are subject to operational feasibility and may not be guaranteed. Cancellation policies and associated charges, if any, are defined within the service agreement with your organization.
8. Intellectual Property
All content, software, designs, trademarks, logos, and materials available on the Platform are the exclusive intellectual property of The Brunch Brigade N.V. or its licensors. No portion of the Platform may be reproduced, distributed, modified, or used for any purpose without prior written authorization. Client data uploaded to or generated within the Platform remains the property of the respective client organization.
9. Platform Availability
We strive to maintain continuous Platform availability; however, we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, system upgrades, or unforeseen technical issues. We will make reasonable efforts to notify affected users in advance of planned maintenance windows.
10. Limitation of Liability
To the maximum extent permitted by applicable law, The Brunch Brigade N.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of revenue, data loss, business interruption, or damages resulting from reliance on information provided through the Platform. Our total aggregate liability shall not exceed the fees paid by your organization for the services in the twelve (12) months preceding the claim.
11. Business-Client Operational Disclaimer
The Platform serves as an operational tool for professional catering and logistics management. Service levels, menu availability, pricing, and delivery parameters are subject to the specific terms of the commercial agreement between The Brunch Brigade N.V. and each client organization. These Terms supplement but do not supersede individual client service agreements.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which The Brunch Brigade N.V. is incorporated. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless otherwise agreed in the applicable client service agreement.
